  1. Create a customer account

You can use the esnero.de online shop without prior registration or creating a customer account. However, you need to create a customer account to access some services and benefits of the esnero.com online shop.

You can create a customer account before making your first purchase. By creating a customer account, you express your initial interest in using the services and benefits of the esnero.com online shop, but you are not obligated to make a purchase. As a registered customer, you can take advantage of certain customer benefits of the esnero.com online shop even before making your first purchase (these benefits are not enforceable).

We will automatically create a customer account for you when you complete your first order to make future purchases easier. We will inform you about this in a message to the email address you provided when placing your first order .

  1. How can you create a customer account?

To create a customer account, you can use any of the options currently offered by the esnero.com online shop (registration on the website, in the app, or via Apple, Google, Facebook, etc.). After entering the required registration data and accepting our terms and conditions, as well as acknowledging our privacy policy, a confirmation email will automatically be sent to the specified email address. To successfully create a customer account, you must confirm your registration.

During registration, we will ask you for some personal information. You don't need to worry, as we only handle your personal data as described in our privacy policy.

Please note that if you create a customer account through a third-party provider (Apple, Google, Facebook, etc.), this process may be subject to different terms and conditions than ours. In such a case, please read those terms and conditions.



By completing the registration and setting up a customer account, you agree to the following:

  • The use of the e-shop esnero.de, including placing orders and the associated conclusion of purchase agreements, is subject to our terms and conditions.

  • You will receive emails from esnero.com (confirmation of customer account registration, confirmation of completed orders, etc.) or may be contacted by esnero.com in other ways (by phone, SMS, etc.) in connection with completed orders, the delivery of purchases, the exercise of your rights due to defects, etc.

  • You are responsible for your customer account and will protect and secure your customer account information by choosing a sufficiently secure password that you will keep secret.
    (d) esnero.com (or the courier delivering your order) may ask you to prove your identity or age in connection with the sale of certain goods (see section 6).

  • The customer account (and therefore the services of the e-shop esnero.com) may not always be available, especially due to necessary maintenance work or random technical problems.


  1. Termination of customer account

If you wish to cancel your customer account for any reason, please contact us at info@esnero.com 

Under certain circumstances, the online shop esnero.com may, at its sole discretion, temporarily or permanently suspend or terminate the customer account of a customer who repeatedly or seriously violates our terms and conditions. In such a case, all unused credits in the form of account balances will be forfeited upon termination of the customer account without refund.

This does not apply to credits that have been uploaded to the customer account:

  • Due to a justified complaint (defective, damaged or missing goods, etc.) or

  • from a gift voucher that you validly uploaded to your customer account and have not redeemed by the time the customer account is terminated.

We will reimburse you for the value of such credits by transferring the corresponding amount to your bank account.

The content published in the esnero.com online shop constitutes an illustrative offer of goods or services that can be purchased and delivered via the esnero.com online shop. This offer does not constitute an offer by esnero.com to conclude a contract. The purchase contract with esnero.com can only be concluded in the manner provided for in Section 3.

If the terms of use of the e-shop esnero.com are changed in the current product range of the e-shop differently than in our terms and conditions, the current product range always takes precedence.

By using the esnero.com online shop, you confirm that you are a natural person, that you possess the necessary legal capacity, that you will use the esnero.com online shop in accordance with these terms and conditions, and that you are at least 18 years old. Your residence or the registered office of your company, etc., must be located in the European Union.

At the same time, as a customer, you commit yourself not to do this:

  • by paying the price of the goods, you agree not to circumvent or infringe the rights of third parties, and you confirm that you are authorized to use the funds to pay for the goods.

  • to make multiple, false or fraudulent registrations of customer accounts,

And finally, the most important thing: How can you order goods from the esnero.com e-shop? Simply follow the steps below.

3.1 Ordering without prior creation of a customer account
You can order goods from the esnero.com online shop without creating a customer account. Simply add the desired items to your shopping cart and follow the steps to complete your order.
To complete your order, we need at least your contact details. Without them, we cannot properly deliver your order. But don't worry, we will always handle your data in accordance with our customer privacy policy.
Since we're sure your first order at esnero.com won't be your last, we'll create a customer account for you as soon as your first order is complete, to make future purchases at esnero.com easier. We'll inform you about this in a message to the email address you provided when placing your first order.

3.2 Ordering after creating a customer account
If you already have a customer account, you can log in with your login details, i.e., your email address and password.


ATTENTION! Please keep your login details secure and do not share them with anyone who should not have access to them and could misuse your account. We recommend using a strong password to log in to your account; that is, a password that is long (ideally 10 characters or more), uses a combination of uppercase and lowercase letters, numbers, or symbols, and does not contain a string of consecutive letters or numbers.


After logging into your customer account, place the desired items in your shopping cart and follow the steps provided to complete your order.
Before completing your order, please check that all the information is correct and familiarize yourself with the estimated price. The final price of your order may vary depending on the specific weight of the goods (see section 6 of our terms and conditions for further details).


3.3 Completion of the order and conclusion of the purchase agreement
As soon as we receive your order, we will confirm it immediately by email. Only upon confirmation does a purchase agreement come into effect and the order become binding between us.
Please note that despite our best efforts, situations may arise where, even after confirming your order, we find that we cannot supply some items due to stock availability. In this case, we will have to cancel the order for the affected goods and, if the order has already been paid for, refund the value of the missing goods in the form of credits, which we will add to your customer account. If you request it, we will transfer money back to the bank account from which the order was paid, instead of credits.
If we have a suitable alternative to the missing item in stock, we can offer to deliver the alternative to you. In this case, we will cover the price difference. However, if the alternative item is cheaper than the item you selected and paid for, we will credit the corresponding amount to your customer account, unless you explicitly request a refund of this amount to your bank account.
Please note that esnero.com reserves the right to deliver goods only in household quantities and only while stocks last. Due to limited space in our delivery vehicles, you can order a maximum of 3 crates of beverages per delivery.

3.4 Changes to completed orders
Additional orders
If you would like your order delivered over a longer period, we can give you the option to add more items to the same order. You will be informed about this option when we confirm your order. Information about the timeframe in which it is possible to add items to your order without creating a new one will be displayed on our website or app. The newly added items will then become part of the original order and will be listed on a single invoice. In this case, you will not be charged an additional delivery fee.

Other changes
Our staff will do their best to customize your order to your specifications. Unfortunately, changes are no longer possible for orders that have already been packed or shipped. In all other cases, it may be possible to modify your order by contacting customer service.

3.5 Delivery and acceptance of an order
Your order will be delivered by one of our couriers to the address you provided. You are obligated to accept delivery of the order unless you exercise your statutory right of withdrawal. The courier will hand over the order to you, to a person present at the delivery address (usually your home), or to a person who proves the order's existence to the courier (e.g., by presenting the order confirmation). The risk of damage to the goods passes to you upon acceptance of the order.
If your order has already been paid for before delivery and you request that the courier deliver the goods without personal contact (e.g., by leaving them in the hallway outside your apartment or at your front door, or placing them in the elevator), we will gladly do so. However, we are then not liable for theft or damage to your goods before you collect them. You can request a contactless delivery by adding a note when placing your order.


ATTENTION! If your order contains tobacco or alcohol products, we must verify that the person accepting the delivery is over 18 years old. Please see section 6 of our Terms and Conditions for more information.

If you refuse delivery of your order, even though we have attempted to send it to you correctly and on time, we are entitled to compensation of €15.00 for the reasonable costs incurred in connection with the delivery of your order. These costs include the preparation, shipping, and delivery of the order. This amount will be charged to you with your next order. If payment is not received by the due date, we are entitled to suspend your customer account until the amount is paid. Of course, you are free to prove that we incurred less than €15.00 in damages.

If you are unable to accept delivery of your order due to a delivery delay, we can only charge compensation of €15.00 for the reasonable costs incurred if the delay is no more than 10 minutes.

If you accept an order from us but fail to pay for it even after being requested to do so by esnero.com, we reserve the right to temporarily suspend your customer account. If the order is not paid for within 14 days of the temporary suspension date, we have the right to delete your customer account and refrain from entering into any future contracts with you. The suspension or deletion of the customer account does not affect esnero.com's right to proper payment of the order price.


3.6 Complaints
It can happen that the goods do not arrive in perfect condition (the goods are defective, damaged, or do not arrive at all, etc.). In such a case, you have the right to file a complaint regarding the order or part of it, as described in our online shop.

3.7 Displaying the content of the esnero.com e-shop
We know how valuable your time is. That's why the online shop esnero.com uses your customer account number and purchase history to display personalized content. Displaying personalized content means that your favorite products will be shown first in each product category to make shopping easier for you. The goal is to save you time by allowing you to complete your purchase as quickly as possible (with as few clicks as possible). Displaying personalized content is not intended to market, advertise, or encourage the purchase of specific products. Each sponsored product advertisement is separate, clearly labeled, and not personalized.

Online payment upon ordering
The easiest way to pay for your order is online when you complete it. You can find an overview of currently accepted payment card types in the esnero.com e-shop when you finalize your order.

Payment by card upon delivery
If you prefer to pay for your order upon delivery, you can pay cashless by card. An overview of currently accepted cards can be found in the esnero.com online shop when you complete your order.

Payment with credit balance (credits)
You can also pay for your order using credit from your customer account. One credit is worth €1.00. If you wish to pay for your order, or part of it, with credits, you don't need to do anything, as this will happen automatically. If you don't want to use credits, simply uncheck the box at checkout to indicate that you want to pay for the order, or part of it, with credits.

The method for topping up your customer account with credits may change from time to time. However, credits are typically added to your account from gift vouchers, returns, or other circumstances.

Please note that credits have a limited validity period. You will be informed of the validity period of each credit type when it is credited to your customer account, or you can check the validity period at any time in your customer account. If you are unsure about the validity period of your credits, please contact our customer service. Credits that are not used within their validity period can no longer be redeemed.

Please note that credits cannot be redeemed retroactively after an order has been placed. If a customer account is terminated, all unused credits will be forfeited without refund (except in the cases described in section 1.2 of our terms and conditions).

Please also note that if you violate our terms and conditions, the following may occur:
(a) Cancellation of an order (usually if the payment process was unlawful) or
(b) Withdrawal of credits from a customer's account without refund (usually in the case of unlawful acquisition).

ATTENTION! Payment methods may change from time to time. An overview of the current payment methods will always be displayed in the esnero.com online shop when you complete your order.

Further important information
All prices listed in the esnero.com online shop include VAT. The purchase price of the ordered goods is only considered paid when it has been fully credited to esnero.com 's account or when the corresponding amount has been duly paid by the courier using the payment terminal upon delivery.

Ownership of the goods will only transfer to you upon payment of the full price, except in the case of the purchase of special categories of goods (for further information see section 6 of our terms and conditions).

We reserve the right, at our sole discretion, to refuse payment transactions that have been identified as fraudulent based on the European Union sanctions database or the EU sanctions card, or where there is suspicion of fraud, money laundering or terrorist financing.

Environmental protection is very important to us, which is why we don't issue physical invoices for purchased goods. The invoice is always available for download in your customer account. The same applies to invoice corrections.

All online payments are processed through our payment provider Adyen, Inc. Esnero.com has no access to the stored payment data and is not liable for the security of the data or for incorrect transactions caused by any errors on the part of the payment provider.

Refunds from us will always be issued only to the account from which the purchase was made.



  1. RIGHT OF WITHDRAWAL


If you have decided to purchase the goods, you, as a consumer, have a right of withdrawal in accordance with the statutory provisions.
If you, as a consumer, exercise your right of withdrawal, you have to bear the regular costs of the return shipment.
Furthermore, the regulations governing the right of withdrawal are detailed below.
Cancellation policy :

a) Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not a messenger, has taken possession of the goods.
To exercise your right of withdrawal, you must inform us, Grünweg GmbH , Bahnhofplatz 2, 63906 Erlenbach am Main, email: info@esnero.com , by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but you do not have to.

To meet the cancellation deadline, it is sufficient that you send the notification of exercising your right of cancellation before the cancellation period expires.

b) Consequences of the revocation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
You will receive your refund in the form of credits in your customer account. The corresponding credit amount will be automatically applied to your next order. Upon explicit request, the amount can also be paid out in euros.
Under no circumstances will you be charged any fees for this refund.

We may refuse reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier.


You must return the goods to us or hand them over to one of our couriers without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send or hand over the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods that was not necessary for testing their condition, properties, and functionality.

The right of withdrawal does not apply to the delivery of goods,

  1. that were manufactured according to your specifications or that are clearly tailored to your personal needs,

  2. which, due to their nature, are not suitable for return, can spoil quickly, or whose expiration date would be exceeded,

  3. Items that are delivered sealed and are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This applies, for example, to hygiene products if the seal has been opened or removed.

  4. if it concerns newspapers, magazines or illustrated magazines.

6.1 Goods sold by weight
Some goods offered in the esnero.com online shop are also sold by weight (e.g., dried fruit, nuts, grain products, fresh produce such as fruits and vegetables). For such goods, the approximate weight of a reference piece (e.g., 1 piece or another unit of measurement) is given, which may vary depending on product availability and size.

The price of the goods is calculated based on the weight of the reference piece and the price per kilogram. The actual price paid by the customer depends on the weight of the delivered goods. If the weight of the delivered products differs from the stated quantity, the final price will be adjusted accordingly.

Example:
One kilogram of almonds costs €15.00. The reference piece weighs 100 grams and costs €1.50. A customer places three reference pieces in their shopping cart. The price displayed in the cart is €4.50. However, the actual weight of the delivered almonds could be 350 grams, and the customer would pay €5.25 based on the actual weight.

Payment and price comparison:
Due to variations in weight, a higher amount (approximately 30% of the value of the ordered, weighed items) is temporarily blocked for online payments, as the exact weight of the goods is unknown at the time of ordering. The unused amount will be refunded after delivery, usually within a few days.

Please note that a weight deviation of up to 30% of the total weight of the ordered goods is possible. However, the online shop will make every effort to minimize this deviation, and the customer will be charged according to the actual weight of the delivered goods.


  1. PURCHASE OF GOODS BY LEGAL ENTITIES


The online shop esnero.com can also be used by legal entities (businesses), typically for operating an office, e.g., to supply office staff with fresh fruit and vegetables, fresh pastries, sandwiches, beverages, or office and cleaning supplies. Please note that purchasing goods for business purposes (e.g., resale) is not possible in the esnero.com online shop.
Please note that section 5 of our terms and conditions does not apply to the purchase of goods by legal entities.
If you wish to shop at esnero.com , you must first register your legal entity via esnero.com .

Payment options for legal entities :


(a) If you require an invoice with company details but wish to pay directly upon ordering or order acceptance, please enter the company's billing details in your customer account. These will then be automatically entered into the invoice, which will be available for download in PDF format from your customer account.
(b) If you wish to pay by invoice after the fact, you must register your company in the esnero.com e-shop and discuss the details with customer service. Purchasing on account is possible for businesses if our internal guidelines are followed.

  1. Delivery areas
    The delivery areas are visible in the online shop, and you can also see the corresponding zones on the map shown. These areas define where we can deliver.

  2. Delivery address and access
    Delivery of your ordered items is generally made to your apartment or house door (the latter for single-family homes) at the specified delivery address. Please note that we can only deliver to addresses accessible by the courier's vehicle. In pedestrian zones or areas with temporary driving restrictions, delivery is only possible during permitted hours. Our deliveries are made exclusively to well-maintained access routes that can be reached by the delivery vehicle.

  3. Self-collection
    Self-collection is unfortunately not possible at esnero.com .

  4. Delivery fee
    A separate delivery fee is charged for each delivery attempt by our courier . The fee amount depends on several factors, such as the chosen delivery time , the delivery day , and the order value . You can view the exact delivery fee in the online shop. The delivery fee will be displayed before you submit your order to prevent any unexpected costs.

  5. Delivery times
    You can also view the general delivery times in the online shop. When you place your order, the next available time slot will be automatically suggested. The various delivery slots are generated from the displayed times. The delivery time slot you select is binding for both parties, you and us.

  6. Missing delivery
    If the courier does not find you at the agreed delivery location within the agreed delivery window, we will contact you by phone to find a solution. However, if we are unable to keep to the agreed delivery window, we will inform you by SMS or push notification .


  1. Current delivery time and delay
    You can check the current delivery time at any time in the app or online shop, as long as you are logged in. In case of a delay, you will be compensated accordingly. Depending on the delay and order value , you will receive a credit of a certain amount . This credit will be sent via email and in the form of credits that you can redeem in the online shop.

  2. Cancellation fees in case of delay
    In the event of a delay that is compensated with credits, we will not charge a cancellation fee if you no longer wish to receive the delivery or are unable to accept it.

  1. Complaint via the webshop
    You are welcome to use the "Report a Problem" function in our webshop if you wish to return an item or submit a complaint. This function is available for up to 72 hours after delivery .

  2. Contact us after the deadline has passed or if you have alternative requests.
    After this period has expired, or if you would like a refund , a redelivery of the desired product, or a replacement product instead of credits , please contact our customer service .

10.1 License Terms
